We are a company registered in Malta with registration number C-62259 and with registered address at 43A/1 Saint Paul's Buildings, West Street, Valletta, VLT 1532, MALTA. We, Working Town suggest that you should read these carefully prior to using the Website, signing up or prior to acquiring any Services as by way of such use, signing up or acquisition you are agreeing to abide by these Terms & Conditions.

These Terms & Conditions shall include and are divided into the following sections:

  1. ‘General Website Terms’ which regulate the use of the Website. Use of the Site and Services indicate that you agree to these General Website terms
     
  2. ‘Job Seeker Terms’ which apply to any person who has signed up to use the Site as a Job Seeker and/or to utilise Job Seeking Services. Signing up with Working Town as a Job Seeker confirms your acceptance of these Job Seeker Terms;
     
  3. ‘Employer and Recruiter Terms’ which apply to any person who has signed up to use the Site as an Employer or a Recruiter and/or to utilise Recruitment Services. Signing op with Working Town as an Employer or a Recruiter confirms your acceptance of these Employer and Recruiter Terms;

Please note that the General Website Terms shall apply to all users of the Website, including Job Seekers, Employers and/or Recruiters unless the said terms are specifically varied  by the respective Job Seeker Terms or Employer and Recruiter Terms.

In addition, Working Town processes your personal data in accordance with our Privacy Policy and its Cookie Policy. Please read these policies where you will find details of how we comply with the Data Protection Act, Chapter 440 of the Laws of Malta, and how we use any personal information you communicate to us.

We shall not be liable to you if the Website is unavailable at any time or for any period. In addition, from time to time we may restrict for any period access to specific sections or areas within the Website at our discretion.

We reserve, to restrict your access to the Website or otherwise to deny you access to the Website or to the Job Seeking Services or the Recruitment Services, in whole or in part, without notice, if you are in breach of these Terms & Conditions.

Prices are all shown in Euro currency €. Working Town reserves the right to change pricing at our discretion and without notice.

Offer cannot be combined with any other codes, promotions or discounts unless otherwise advertised. Limit one coupon per customer per transaction only.
 

Our Liability

The material contained on the Website and in the Services is for informational purposes only and does not constitute advice including but not limited to advice as to the suitability of any Employer, Recruiter or of any Job Seeker. We give no warranties of any kind, unless expressly provided for in writing. Notwithstanding any other clause in these Terms & Conditions, we are therefore not liable to you for any action that you may take on the basis of information provided on this Website.

In addition, the do not guarantee that the Website and the Services shall be error free and/or free from bugs or other defects.

Notwithstanding any other clause in these Terms & Conditions, Working Town shall have no liability to you for any consequential, special or indirect losses including without limit loss of revenues, profits, contracts, business, or anticipated savings damage to or loss of goodwill, reputation or data.

Without prejudice to the foregoing, and notwithstanding any other clause in these Terms & Conditions our total aggregate liability to you under and/or arising in relation to this contract shall not exceed the amount paid by you for any Services that you may have acquired.

However, we do not exclude liability which we are not permitted to exclude or limit as a matter of law. The above exclusions and limitations apply only to the extent permitted by law. None of your legal rights as a consumer in terms of the Consumer Affairs Act, Cap 378 of the Laws of Malta or under relevant legislation are affected.
 

Indemnity

You agree to indemnify, defend and hold harmless Working Town, its officer, employees, consultants, agents and affiliates, from any and all third party claims, liability, damages and/or costs (including but not limited to legal fees), arising from your use of this Website or your breach of these Terms & Conditions.
 

Force Majeure

Neither Party shall be liable to the other for any failure to perform any obligation under any agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any agreement contained herein.
 

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled herein shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any agreement. No waiver of any of the provisions of this or any agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
 

Severability

If any term or condition in these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction or by any competent authority, the validity, legality and enforceability of the remaining Terms & Conditions shall remain in full force and effect. 
 

Entire Agreement

The above Terms and Conditions constitute the entire agreement of the Parties and supersede any and all preceding and contemporaneous agreements between you and us. Any waiver of any provision of the Terms & Conditions will be effective only if in writing and signed by Working Town.
 

Jurisdiction and Choice of Law

These Terms and Conditions are governed by the laws Malta, and the parties submit to the exclusive jurisdiction of the Maltese courts in relation to any dispute (contractual or otherwise) concerning these Terms and Conditions. However, in the event of a dispute, it is advisable that you first lodge a complaint with us and we will do our utmost to reach an amicable settlement with you within a reasonable time.
